How's the appeal going? Somebody ( petition author? signatories, media), somewhere, must be able to update us.

Common sense tells us that there'll be nothing more of great interest until there's a date for the hearing.

It seems that despite all the noise from posters, petitioners, letter and headline writers, no one knows - or cares - if an appeal has been submitted.  

So in the interests of transparency and openness, has an appeal actually been submitted?

The last i saw was a headline that was the RFL allowing him to appeal straight to the sports panel people.. therefore I would assume that is what has happened, but its an assumption rather than a confirmation.

Common sense tells us that there would have been no point in making all this fuss if there was no intention of making an appeal.

Be patient.  It took two months to exchange legal stuff last time.   Probably take the same again.

Victory: RFL backs down and agrees to independent review

 

In a significant victory, the Rugby Football League (RFL) has relented and agreed to allow Mark Aston's case to be reviewed by Sport Resolutions, the UK's leading independent sports arbitration service used by virtually every other major sport, including football, rugby union and tennis.

This breakthrough ensures that Mark's 18-month suspension will now receive proper independent scrutiny....

Yes, I saw that.  Really looking for authoritative  confirmation from either him or the club that he actually has appealed.  After all the fuss, it's all gone quiet.

They do know that Sports Resolutions is the RFL's named body for independent arbitration, don't they?

Give us a reliable source who said they "refused to take the matter to Sports Resolution" rather than just making it up.

For me, it's not so much an issue of the reporting of the situation in the media - after all, it's their proper function and they can take whatever editorial position they like.

It's more about the cone of silence under which the most vociferous critics of the RFLs process, actions and  sanction are sheltering. In this case, silence from them is NOT golden., 

It might help of course if the RFL were to issue an update, though that wouldn't make any difference to anyone who is joining in looking for argument for arguments sake.

There is a lot around this that we can concentrate on, I really don't understand this line that is being taken "the RFL not allowing appeal" when all they actually want to do is follow their process, which is what Aston says they didn't do In the first place. He wanted to skip a stage but it's still the RFL process using the RFL approved people it's not the "gotcha" some people are making out. 

The key in this is still... Did Aston knowingly play a play that had not passed the return to play protocols? If he did he deserves the ban, if he didn't then he doesn't.. the rest is fluff.. 

If the RFL also made mistakes around this then that is separate to the whole "did Aston know" debate.. it is fair and it should be looked in to without appropriate punishments etc (there was obviously a problem hence them tendering for a new system).. but it doesn't detract from the Aston case.

There's no "skipping". There's only one appeal. It's either to the RFL again or to Sports Resolution.
