We’ve received a summons from a parking company despite providing them with evidence showing that the claim is incorrect 

The case is due to be heard at Northampton 

How do we get the case transferred to our local county court?

If the internet's taught us anything, it's to turn up with a wad of photocopied gibberish and shout about Magna Carta 'til they chuck you out.

Not my main forte but I believe the main money court centre is based in Northampton which is why it is going there.

You can reply online or by post dependent on how you've been summoned.

I've had instances like this due to historical situations with ex etc. And are ongoing. As stated Northampton is a generic court so to speak.

A god send to me has been National Debtline of which is free and a charity. You don't have to be in debt to contact but they've been bang with legal advice like this.

OK phil, I am guessing you have received the court documents. In these documents is the ability to choose the court where you would like the hearing. Maybe you have to give a reason for change but mine too was northampton. Yes my request was accepted to Birkenhead, which is my nearest county court.

I too a few years ago ignored the parking charge as it was wrong but they now follow up with a county court hearing as it only costs them £25 to start proceedings. 

It's basically a numbers game, they think that the very mention of county court will frighten people into paying up.

Parking eye was the company.

I did take them on and won...don't let them intimidate you, if I can offer anymore help don't hesitate.

Just as a side note the postage mark from Parking eyes' correspondence was i'm sure bishop auckland way, yet their head office is chorley and they wanted me to turn up in northampton for a so called offence in liverpool........yeah, totally nuts.

omg, just realised I have ommited the main bit, Parking eye decided to withdraw the case pre court and they also do not send a solicitor to court to fight the case from the information supplied

Thanks for that, we have the evidence that we paid the charge and that we did not overstay. They have chosen to issue even though we have provided them with this evidence and informed them that we intend to defend the charge.

You should inform them in writing that you intend to counter claim for your time and trouble defending the case

 

then when you win hit them with the small claims court

There is a part of the court papers that allows you to do that, counter claim as it were

So we’ve informed the court that we intend to defend the claim, that we wish the case to be transferred to Bradford county court and that we will be entering a counter claim.

We’ve received an acknowledgment of this from the court

To add to this I've been issued with a notice of enforcement force 5 figure some and one month later have still not been given anymore details. (I'm partly aware what it's about and have a case to dismiss it at a later). I wanted to go through the courts. I put in a N244 to start the ball rolling. I had constant phone calls and a letter saying if I put a payment plan together it doesn't have to go to court or I'll be charged 2k for costs. This got thrown out and awarded in my favour. 

So many vultures out there.

They tried that with me. They said upon receipt of further evidence (they never said what evidence but I knew it was because my mate had asked the hotel to inform parking eye to drop the charge) and to bring the case to a conclusion they would settle for half the fee. I never replied but when the time came I submitted as supporting evidence to the court the email request to the hotel to get parking eye to drop the charge....that kind of thing helps.

When's the court date Phil?

With mine I'm having to put a potential case together. I've asked the claimants solicitor for any information about the claim dates etc.

I got 61 pages. All bumpf (spl). Only 1 page was relevant but random. I have not owned the property since 2016. Yet they charged me 400 quid in 2023 for a service charge. I'm not going to tempt fate though. I think a lot of companies don't expect opposition to claims and make their money from the people that don't ask questions.

The courts will ask both parties to supply evidence to be used in court both to each other and the court by a certain date. 

I deliberately sent mine to parking eye close to the cut off date, so they could not react and come up with some other bullshine......which they did but was after the date. I then informed the court not to accept their rejigged evidence as it arrived after the cut off date.

I assume the court told them it was inadmissable as they dropped the case soon after.
